How to File a FOIA Request with the FBI (2026 Guide)

Everything you need to know about filing a Freedom of Information Act request with the FBI, including processing times, common exemptions, and how to appeal.

By Thomas Miller, Esq.T Miller Law

The FBI receives more FOIA requests than almost any other federal agency. Here's how to file one effectively and what to expect.

How to Submit Your Request

The FBI accepts FOIA requests through:

  • eFOIPA Portal — The FBI's electronic submission system at efoia.fbi.gov
  • Email — foiparequest@fbi.gov
  • Mail — FBI FOIPA Request, Attn: FOIPA, 200 Constitution Drive, Winchester, VA 22602
  • FOIAfile handles the formatting and delivery for you — just describe what you're looking for and we'll generate a properly formatted request.

    What Can You Request?

    Common FBI FOIA requests include:

  • Your own FBI file — Any records the FBI maintains about you
  • Files on public figures — Historically released files on individuals of public interest
  • Investigation records — Documents related to specific investigations (subject to exemptions)
  • Policy documents — FBI policies, guidelines, and procedures
  • Statistical data — Crime statistics, staffing data, budget information
  • Processing Times

The FBI's FOIA processing times are among the longest of any federal agency:

  • Simple requests: 3-6 months
  • Complex requests: 1-3 years
  • Expedited processing: Available for demonstrated "compelling need"
  • Under FOIA, the FBI is required to respond within 20 business days. In practice, most requests take significantly longer. If the FBI misses the deadline, you've exhausted your administrative remedies and can file suit.

    Common FBI Exemptions

The FBI frequently invokes these FOIA exemptions:

  • Exemption 1: Classified national security information
  • Exemption 5: Deliberative process privilege (internal communications)
  • Exemption 6: Personal privacy
  • Exemption 7(A): Interference with law enforcement proceedings
  • Exemption 7(C): Unwarranted invasion of personal privacy (law enforcement records)
  • Exemption 7(D): Confidential sources
  • Exemption 7(E): Law enforcement techniques and procedures
  • Tips for a Successful FBI FOIA Request

  • Be as specific as possible — Narrow requests are processed faster
  • Include date ranges — Helps the FBI locate responsive records
  • Request expedited processing if you have a compelling need
  • Request a fee waiver if the information serves the public interest
  • Demand segregability — Even if parts are exempt, non-exempt portions must be released
